1.3. We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on this page, and your continued use of the website after such changes constitutes your acceptance of the new terms.

2. Product Information, Availability, and Pricing

2.1. While we strive to ensure that all product descriptions and prices are accurate, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled.

2.2. All prices displayed are in South African Rands (ZAR) and include Value-Added Tax (VAT) where applicable.

2.3. The availability of products is subject to change without prior notice. We will inform you if a product you have ordered is not available and offer a refund or a suitable alternative.

3. Orders and Payment

3.1. Placing an order on our website constitutes an offer to purchase the goods. All orders are subject to acceptance by us. A contract for the sale of goods will only be formed when we dispatch your order and send you a confirmation email.

3.2. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity.

3.3. Payment must be made using the payment methods available on our website. You agree to provide current, accurate, and complete payment and account information for all purchases. We do not store your credit card details; all payments are processed securely through a third-party payment gateway.

4. Shipping and Delivery

4.1. We deliver within South Africa only.

4.2. Delivery times are estimated to be 2-5 working days from the date of your order. These times are estimates and may be subject to change due to unforeseen circumstances beyond our control (e.g., courier delays, extreme weather conditions). We will not be held liable for any loss or damage suffered by you due to any such delays.

4.3. The risk of loss and title for products purchased from LaMara Paris passes to you upon our delivery of the items to the designated courier or postal service.

5. Returns and Refunds

5.1. Returns and exchanges are governed by our Returns & Exchanges Policy, which forms part of these Terms and Conditions.

5.2. In summary, items must be returned unused, unworn and in their original packaging, and your return or exchange must be logged within 10 days of receiving your order. Sale and discounted items may also be returned, but courier costs may apply. Orders placed with free delivery do not qualify for a free return or exchange.

5.3. Approved refunds are made to your original method of payment. Cash refunds are not provided.

5.4. Nothing in these Terms and Conditions limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act, including your rights in respect of defective goods.

5.5. If anything in this section differs from our Returns & Exchanges Policy, the Returns & Exchanges Policy applies.

6. Limitation of Liability and Indemnity

6.1. To the fullest extent permitted by South African law, LaMara Paris, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profit, loss of data, or any other loss arising out of or in connection with your use of our website or the purchase of our products.

6.2. Our total liability to you for any claim arising out of or related to these Terms and Conditions or the use of our services is limited to the amount you paid for the product in dispute.

6.3. You agree to indemnify and hold LaMara Paris harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your breach of these Terms and Conditions.

7.1. We are committed to protecting your privacy in accordance with the Protection of Personal Information Act (POPIA). By using our website, you consent to the collection and use of your personal information as outlined in our Privacy Policy.
